TERMS AND CONDITIONS – OVERVIEW

By booking any of our walking related tours or products, it will be assumed you have read, understood and agree to be bound by the terms and conditions set out below, including our conditions and waivers regarding your participation in outdoor activities undertaken in conjunction with Yuraygir Walking Experiences (operated by Clarence Valley Experience Pty Ltd).

After booking, you will be required to complete a registration process (depending on the tour/product selected) in which you are asked to provide accurate and honest information regarding any medical conditions, treatments, allergies and food restrictions that apply to you and which would have the potential to adversely affect you in the course of participating in this activity.

YWE recommends you purchase travel insurance to cover you in case of illness or other emergency before or during the trip (see conditions below regarding cancellations and refunds).

 

(1) BOOKINGS

Many of our tours require payment of a deposit of 25% at booking, with the balance of payment to be made 4 weeks (28 days) ahead of the tour commencement date. Where bookings are made within 28 days of tour commencement, we require payment of the full fee at that time.

Accommodation

In circumstances where accommodation is included in the tour/product selected, we try to make bookings as early as we can to obtain the best options available to satisfy our guests’ accommodation preferences. In such tours, upgrades to the standard accommodation provided are possible, via payment of an accommodation upgrade supplement (see more information about accommodation and upgrades). Please arrange any upgrades at least 28 days before the start of the tour.

If your walking tour involves DIY camping or other accommodation arrangements, you are responsible for bookings and associated fees and charges. Should you be unable to make suitable accommodation arrangements after booking a walk, standard conditions will apply to tour cancellation, changes and refunds (see below), so it is recommended you organise accommodation early.

Minimum numbers

We need a minimum number of walkers to operate most of our walking tours. Each tour has a stated minimum required number and the booking calendar for each tour (when restricted to specific dates) indicates the number of spaces available / remaining. Final confirmation of tour bookings is dependent upon the achievement of the minimum number of bookings for that tour. Customers are therefore advised that their booking is ‘pending’ until that time. It is recommended awaiting confirmation of the walk proceeding before paying for any transport or accommodation needed to get to the Yuraygir area.

In the event that 4 weeks (28 days) prior to those dates there are insufficient numbers to run a given walk, customers will be notified and given the option of a refund, to pay a minimum fee to run the walk regardless of numbers, or a change of dates to join another walk.

YWE recommends you purchase travel insurance to cover you in case this cancellation affects any of your other travel arrangements.

Refunds due to cancellations and changes made by you

We understand that circumstances can arise where you may need to cancel or alter your booking. Should this occur, our need to pre-book a number of services related to tours means the following refund conditions apply relative to the amount of cancellation notification time provided:

  • 28 (or more) day’s notice given prior to start of tour – full deposit and any other amounts paid will be refunded without incurring a cancellation fee. We will however charge an administration/bank fee of $25 to cover our costs.
  • 27–15 day’s notice given prior to start of tour – 75% of all monies paid will be refunded. [Note: this includes 25% deposit required 28 days ahead of tour]
  • 14–7 day’s notice given prior to start of tour – 50% of all monies paid will be refunded. [Note: this includes 25% deposit required 28 days ahead of tour]
  • Less than 7 day’s notice given prior to start of tour, we will be unable to refund any monies paid by you. Transfer to alternative dates may however be arranged, subject to availability, but in this instance an administrative fee of $25 and a further fee to cover any losses incurred by us for any forfeited bookings or purchases relating to the cancelled dates will also apply.

Please contact us as early as possible if you think you may need to cancel or amend your booking.

 Refunds due to cancellations or changes made by us, or due to unavoidable circumstances affecting us

We reserve the right to make changes due to circumstances that might arise that affect our ability to deliver the tour or support service you have paid for. In the event that we are forced to change your arrangements due to circumstances that are our responsibility to manage, substitute arrangements of a similar standard will be provided. However, YWE will not be liable where interruptions to itineraries or cancellations are caused by weather conditions, technical problems to transport used by YWE, industrial action, political or civil commotion or other circumstances beyond our control.

YWE recommends you purchase travel insurance to cover you in case of any changes that we are forced to make in response to any circumstances that affect our ability to deliver on our services. 

 

(2) FLEXIBILITY OF ARRANGEMENTS

We will always seek to maximize the quality and enjoyment of the trip for you and our priority is the comfort and safety of all of our guests. Sometimes this will require flexibility in the schedule to meet weather conditions or other circumstances as they arise. YWE reserves the right to make any changes it deems necessary to the package and the details of the schedule to ensure the comfort and safety of all guests. YWE will inform you at the earliest possible notice of any such changes to ensure that they remain satisfactory to you.

YWE recommends you purchase travel insurance to cover you in case conditions are such that part or all of the walking tour needs to be cancelled or amended and that this affects any of your other travel arrangements.

 

(3) YOUR AGREEMENT REGARDING PARTICIPATION IN WALKING TOUR ACTIVITIES

We will do our utmost to provide you with accurate information at all times to ensure your safety during your walk, whether guided or self-guided. However, because there are events that may occur that are beyond our control, it is also necessary for you to be clear that your safety is primarily your responsibility and that you undertake these activities with full awareness of this fact. We also claim the right to gain your agreement to a waiver in respect of our responsibilities in facilitating your participation in walking tour activities, and associated activities such as are necessary to undertake the Yuraygir Coastal Walk.

It is assumed that by making an activity booking with us you have read, understood and agreed to be bound by the following conditions regarding your participation in the activity:

  • “Activity” refers to any and all activities you undertake during your participation in a guided or self-guided walking tour, as described on the Yuraygir Walking Experiences website. The “Activity” refers to any and all activities (including river crossings by boat or wading) undertaken in response to directions or advice provided by a Guide or Staff before or during guided walks, or undertaken by you independently of the directives of advice of Guides or Staff before or during such walks.
  •  “Guide” refers (where applicable) to a person or persons employed by Clarence Valley Experience (CVE) Pty Ltd, with responsibility for leading guided walks within Yuraygir National Park and settlements within that vicinity.
  • “Staff” refers to a person or persons employed by Clarence Valley Experience (CVE) Pty Ltd/Yuraygir Walking Experiences, including guides, drivers, catering staff or others connected with walking tours within Yuraygir National Park and settlements within that vicinity.

 (a) Participants understand the physical nature of the activity and understand and acknowledge that it is a condition of participation in this activity that they do so at their own risk.

(b) Participants acknowledge that their participation in this activity may involve risk due to the outdoor nature of the activity.

(c) Participants recognise the difficulties associated with the activity and attest that they are physically fit to participate safely in the activity and that a qualified medical practitioner has not advised them otherwise.

(d) Participants are not aware of any medical condition, injury or impairment that will be detrimental to their health if they participate in this activity. In the event that participants become aware of any medical condition, injury or impairment that may be detrimental to their health if they participate in this activity, guides or staff will be immediately informed. By continuing to participate in this activity, participants accept the risks despite these conditions and are still, and will always, be under the terms of this agreement.

(e) Participants accept all risks associated with undertaking the activity and hereby indemnify and release guides, staff, their agents, affiliates, employees, members, sponsors, promoters and any person or body directly or indirectly associated with the guide or staff, against all liability (including liability for their negligence and the negligence of others) claims, demands, and proceedings arising out of or connected with their participation in this activity.

(f) In such cases where, to facilitate your walking tour, staff of YWE are required to drive a vehicle owned by you, or a vehicle under your care and control (including hire vehicles), it is incumbent upon you to make appropriate insurance arrangements in advance that will ensure that no liability for any form of damage to that vehicle will be carried by YWE and its staff.

(g) Participants understand and accept personal responsibility for any and all risks associated with on water activities, including crossing rivers by boat with a person or persons engaged by YWE.

(h) This release and indemnity continues forever and binds participants’ heirs, successors, executors, personal representatives and assigns.

(i) Participants certify that they are 18 years or older and that they have read these conditions of agreement and fully understand them, OR (if appropriate), parents or guardians of the participant,  (i) agree to the above for themselves and on behalf of the participant(s) and (ii) indemnify and will keep indemnified any person or body directly or indirectly associated with the conduct of the activity on the terms referred to above.
